For the purposes of these Terms and Conditions, CALDOR HEAT & ENGINEERING S.R.L., . is referred to as the Seller, and the person or legal entity placing an order is referred to as the Buyer.

By accessing, using, or placing an order on any of the above-mentioned websites, the Buyer confirms that they have read, understood, and accepted these Terms and Conditions.

These Terms and Conditions govern all purchases, orders, deliveries, returns, warranty matters, technical approvals, custom-made products, and contractual relations between the Seller and the Buyer.

These Terms apply exclusively. Any other terms, purchasing conditions, contractual clauses, or commercial conditions proposed by the Buyer shall not apply unless expressly accepted in writing in advance by the Seller.

The version of the Terms and Conditions valid at the moment the order is placed shall apply to that order.

By submitting an order, the Buyer confirms acceptance of these Terms and Conditions, without prejudice to any mandatory rights granted to consumers under Romanian and European Union law.

The Buyer is solely responsible for providing complete and correct contact, invoicing, delivery, and payment information. Orders placed with incorrect email addresses, phone numbers, company details, VAT numbers, or delivery addresses may be delayed or cancelled if communication with the Buyer is not possible.

2. Buyer Categories

For the correct interpretation of these Terms and Conditions, the following categories apply:

Consumer / B2C Buyer means a natural person purchasing products for purposes outside their trade, business, craft, or profession.

Professional Buyer / B2B Buyer means a company, authorized person, reseller, manufacturer, industrial user, public authority, institution, or any person purchasing products for professional, commercial, industrial, or resale purposes.

Certain rights, including the statutory right of withdrawal, apply only to Consumers and only under the conditions provided by Romanian and European Union law.

Professional Buyers are subject to the commercial conditions agreed with the Seller, including order confirmation, technical approval, payment terms, custom production rules, industrial tolerances, warranty limitations, and non-returnable product rules.

3. Pricing and Currency Policy

Prices displayed on the websites listed above apply as follows:

For Romania

All prices are expressed and payable exclusively in RON.

For European Union countries outside Romania

Prices may be expressed and payable exclusively in EUR, unless otherwise agreed in writing by the Seller.

For EU B2B Buyers, VAT treatment depends on the validity of the Buyer’s VAT number and the applicable intra-Community VAT rules.

If the Buyer provides a valid EU VAT number that can be verified through the official VIES system or other applicable official verification channels, the order may be invoiced according to intra-Community supply rules, where applicable.

If the Buyer’s VAT number cannot be verified, is invalid, is incomplete, or does not correspond to the Buyer’s company details, the Seller reserves the right to charge the applicable VAT. In such cases, the Buyer shall be responsible for paying VAT where required by law.

For countries outside the European Union

Prices are expressed and payable exclusively in EUR, unless otherwise agreed in writing by the Seller.

For non-EU countries, customs duties, import VAT, customs clearance costs, brokerage fees, local taxes, and any other import-related charges are the exclusive responsibility of the Buyer. The Seller is not responsible for customs delays, import restrictions, refused customs clearance, or additional costs imposed by authorities in the destination country.

Accepted currencies

The Seller accepts only:

  • RON for Romania

  • EUR for European Union and international orders, unless otherwise agreed in writing

USD is not accepted under any circumstances.

Payments in USD, cryptocurrencies, virtual currencies, alternative payment units, or any other currency not expressly accepted by the Seller are strictly refused.

The Seller reserves the right to refuse, suspend, or cancel any order placed using an unsupported, unauthorized, or incorrectly transferred currency.

Unless otherwise specified, all prices are exclusive of VAT.

For Consumer orders, the final payable amount, including applicable VAT and delivery costs, shall be communicated before order confirmation, where required by law.

Prices and product availability may be modified without prior notice, depending on supply conditions, raw material costs, exchange rates, production workload, supplier availability, import costs, and market fluctuations.

4. Payment Methods

Payments are accepted only in the applicable currency defined above and may be made using the following methods:

  • Cash on delivery, Romania only, where available and only for eligible standard stock products

  • Cash payment upon pickup at the Seller’s premises

  • Bank transfer based on invoice or proforma invoice

  • Other payment methods expressly confirmed in writing by the Seller

For Special Orders, custom-made products, imported-on-request products, or products manufactured according to Buyer specifications, an advance payment of 50% of the total order value is mandatory, unless otherwise agreed in writing.

An advance invoice or proforma invoice may be issued after order confirmation.

The order is considered valid only after receipt of the advance payment and, where applicable, after written confirmation of the technical specifications, drawings, dimensions, material, voltage, wattage, cable type, sensor type, and other required production details.

Production or procurement shall not start until the required advance payment and technical confirmation are received.

The remaining balance must be paid before delivery, unless otherwise agreed in writing.

The Buyer is solely responsible for ensuring that the payment is made to the correct bank account, in the correct currency, with the correct invoice or proforma reference.

Payments made to incorrect accounts, in incorrect currencies, without proper invoice reference, or based on outdated, incorrect, or unconfirmed payment details do not discharge the Buyer’s payment obligation and may be treated as unpaid until the situation is correctly resolved.

5. Delivery Policy

For products available in stock, dispatch is usually performed within 1 to 3 working days from order confirmation and payment confirmation, unless otherwise communicated by the Seller.

The delivery period may be extended due to payment delays, courier delays, public holidays, stock differences, import delays, technical verification, force majeure, or circumstances outside the Seller’s control.

If a product is not available in stock, the estimated delivery time will be communicated by phone, email, quotation, proforma invoice, or order confirmation.

Delivery is performed by courier service, transport company, or pickup from the Seller’s premises, depending on the order type, product size, destination, and agreement between the parties.

Courier delivery is made only to the building entrance or delivery address specified by the Buyer. Products are not delivered inside residential, commercial, industrial, or restricted-access premises unless expressly agreed in writing.

The Buyer is responsible for ensuring that the delivery address is accessible and suitable for courier delivery.

Free delivery is not offered unless expressly confirmed in writing by the Seller.

Delivery costs, transport insurance, customs clearance costs, import duties, local taxes, and special handling charges are borne by the Buyer unless otherwise agreed in writing.

The Buyer must inspect the package upon delivery. Visible transport damage, missing packages, broken packaging, or delivery irregularities must be noted immediately on the courier document and communicated to the Seller without delay.

6. Return Policy for Standard Products

Consumers purchasing remotely may exercise the right of withdrawal in accordance with O.U.G. 34/2014, within 14 calendar days from the date of receipt of the product, without stating a reason, except in cases where legal exceptions apply.

The withdrawal request must be submitted in writing to:

This right applies only to Consumers and only to eligible standard products.

Returned products must be unused, uninstalled, undamaged, clean, complete, and in the same condition as delivered, including:

  • original packaging

  • all accessories

  • intact labels

  • accompanying documentation

  • invoice or proof of purchase

  • technical documents, if supplied

Returns are accepted only for standard products normally available in stock and eligible for resale as new.

Products that have been installed, electrically connected, modified, damaged, scratched, contaminated, used, tested in industrial operation, overheated, cut, mechanically altered, or otherwise made unsuitable for resale as new cannot be accepted for return, except where a confirmed non-conformity exists under mandatory consumer law.

Return shipping costs are borne by the Buyer, unless the return is caused by a confirmed non-conformity attributable to the Seller.

The Seller may withhold reimbursement until the returned goods are received and inspected or until the Buyer provides proof of return shipment, where applicable under law.

Refunds shall be processed in accordance with applicable legal requirements. Where possible, the Seller may process the refund within 5 working days after receipt and inspection of the returned product.

If the returned product cannot be resold as new, the Seller reserves the right to deduct a reconditioning fee, repair cost, missing parts cost, or value reduction, to the extent permitted by applicable law.

7. Imported Products and Imported-on-Request Products

Imported products normally held in the Seller’s stock are treated as standard products, provided they are eligible for resale as new and are not installed, used, damaged, modified, or custom-configured.

Products imported specifically at the Buyer’s request, based on a firm order, technical confirmation, supplier procurement, advance payment, or special quotation, are treated as Special Orders.

Imported-on-request products cannot be returned or cancelled after procurement has started, except where mandatory consumer rights apply or where a confirmed non-conformity exists.

The Buyer acknowledges that imported-on-request products may involve supplier lead times, customs procedures, transport delays, supplier restrictions, minimum order quantities, and non-returnable procurement conditions.

8. Special Orders and Custom-Made Products

Custom-made products and Special Order products are not eligible for return, except under the conditions expressly provided in these Terms or mandatory applicable law.

A Special Order is defined as any product that is:

  • manufactured according to Buyer specifications

  • manufactured according to approved drawings

  • manufactured according to requested dimensions, wattage, voltage, material, cable, connector, sensor, shape, flange, thread, or technical configuration

  • not normally available in stock

  • imported specifically at the Buyer’s request

  • supplied based on a firm order and advance payment

  • technically adapted for a specific machine, installation, process, or industrial application

This provision is applied in accordance with O.U.G. 34/2014, including the exception for products made according to consumer specifications or clearly personalized products.

Once the Buyer approves the technical drawing, quotation, proforma invoice, specification sheet, or written technical description, the Buyer becomes responsible for the accuracy of the approved information.

The Seller manufactures according to the approved information. If the Buyer approves an incorrect drawing, incorrect dimensions, incorrect technical data, wrong voltage, wrong wattage, wrong shape, wrong fitting, wrong cable position, wrong sensor type, or any other incorrect specification, the resulting product shall be considered manufactured according to Buyer-approved data.

Special Orders may be cancelled within 48 business hours from written confirmation, provided that production, material preparation, engineering work, supplier procurement, or import procurement has not already started.

After this period, or after production, procurement, cutting, forming, machining, engineering, drawing preparation, or material reservation has started, the order cannot be cancelled without cost.

If the supplied custom-made product deviates from the approved drawing or agreed specifications outside the applicable tolerance limits, the Buyer must notify the Seller in writing within 3 working days from delivery.

The notification must clearly specify the alleged non-conformity and must include photographs, measurements, drawing references, and any relevant technical evidence.

The Buyer must return the product for technical inspection if requested by the Seller.

After technical inspection, if the non-conformity is confirmed and is attributable to the Seller, the Buyer may request one of the following remedies:

  • correction or repair of the product

  • replacement of the product

  • refund of the product value, where replacement or correction is not possible

No claim shall be accepted for Special Order products if the alleged issue results from Buyer-approved drawings, wrong Buyer specifications, incorrect installation, unsuitable operating conditions, improper electrical connection, mechanical damage, overheating, contamination, or use outside the agreed technical parameters.

9. Engineering, Design and Order Cancellation

Special Order products may require engineering analysis, technical drawings, project preparation, material evaluation, technical consultation, supplier verification, and production planning prior to manufacturing.

If the order is cancelled during the order stage, CALDOR HEAT ENGINEERING S.R.L. reserves the right to retain up to 50% of the total order value to cover:

  • engineering work

  • drawing preparation

  • technical service

  • project evaluation

  • material evaluation

  • production preparation

  • supplier communication

  • administrative processing related to the custom project

The remaining balance, if applicable, will be refunded to the Buyer.

If the order does not proceed to production, the costs related to technical design and engineering services remain applicable.

For custom-made products, the Buyer acknowledges that the 50% advance payment may represent technical, engineering, design, administrative, and project preparation costs, and not only material or production costs.

If the Buyer decides to place the same order again within 5 working days, only 50% of the previously retained amount must be paid again, unless otherwise agreed in writing.

If this period exceeds 5 working days, the original quotation becomes invalid and a new quotation must be issued.

10. Warranty

Products purchased through the official websites benefit from a limited commercial warranty between 6 and 12 months, depending on the product type, technical specifications, working conditions, and agreed commercial terms.

For custom-made products, the warranty period and warranty conditions may depend on the Buyer’s technical requirements, working environment, temperature, voltage, wattage density, installation conditions, requested materials, and approved specifications.

Warranty conditions apply only when products are used according to technical specifications, operating conditions, installation instructions, safety requirements, and professional electrical standards.

The warranty does not cover defects or damage caused by:

  • incorrect installation

  • incorrect voltage

  • incorrect wiring

  • lack of grounding

  • lack of temperature control

  • lack of over-temperature protection

  • operation without proper thermostat, sensor, SSR, contactor, fuse, or safety system

  • overheating

  • dry running of immersion heaters

  • unsuitable medium or chemical environment

  • corrosion caused by unsuitable liquid or oil

  • mechanical impact

  • cutting, bending, modifying, drilling, or altering the product

  • use outside technical specifications

  • poor thermal contact

  • incorrect hole tolerance for cartridge heaters

  • wrong clamping of band heaters

  • excessive tightening or insufficient tightening

  • contamination by plastic, oil, chemical deposits, water, or foreign substances

  • use in machines or installations not suitable for the product

  • normal wear in industrial use

For Consumer sales, the commercial warranty does not affect the legal guarantee of conformity provided by Romanian and European Union law, including O.U.G. 140/2021, where applicable.

For B2B sales, warranty conditions are limited to the commercial warranty expressly provided by the Seller, the quotation, the invoice, the warranty certificate, or the written agreement between the parties.

11. Production Tolerances

Unless otherwise agreed in writing or specified in the approved technical drawing, the following production tolerances apply:

Band heaters

Dimensional tolerance: ±15%

Cartridge heaters

Dimensional tolerance: ±7%

Tubular heaters

Dimensional tolerance: ±10%

Wattage tolerance

Wattage tolerance: ±12.5%, unless otherwise agreed in writing.

These tolerances are standard commercial manufacturing tolerances for industrial heating elements and may vary depending on product type, material, diameter, shape, production method, thermal expansion, forming process, insulation material, and technical configuration.

For custom-made products, the applicable tolerance shall be interpreted in relation to the approved drawing, product type, technical feasibility, and intended industrial use.

If the Buyer requires stricter tolerances, this must be clearly requested and accepted in writing before order confirmation and before production starts.

12. Production and Delivery Time for Special Products

Production time for custom-made or Special Order products usually ranges between:

3 and 40 working days

excluding transportation time.

The production period starts only after:

  • receipt of the required advance payment

  • written confirmation of the final technical specifications

  • written approval of the technical drawing, where applicable

  • confirmation of required materials or imported components

  • confirmation of all missing technical details requested by the Seller

Production and delivery times are estimates and may vary due to workload, supplier delays, material availability, import delays, technical complexity, public holidays, courier delays, force majeure, or circumstances outside the Seller’s control.

The Seller shall make reasonable efforts to respect the communicated production time but shall not be liable for indirect losses caused by delays, unless mandatory law provides otherwise.

13. Obligations and Liability

Technical data and information published on the websites are provided for informational purposes only.

Product images are illustrative.

CALDOR HEAT ENGINEERING S.R.L. reserves the right to update website content, including technical specifications, images, descriptions, prices, stock status, product categories, delivery conditions, and commercial information, without prior notice.

The Seller shall not be liable for damages resulting from the use, copying, or display of website content, nor for service interruptions caused by technical failures, hosting issues, server problems, internet failures, cyber incidents, maintenance, or circumstances outside the Seller’s control.

Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is not permitted under applicable Romanian or European Union law.

The Buyer is responsible for ensuring that the exclude or limit liability where such exclusion or limitation is not permitted under applicable Romanian or purchased product is suitable for the intended application, machine, voltage, installation, environment, process temperature, control system, and safety requirements.

Industrial heating elements must be installed and operated only by qualified personnel, using appropriate protection, grounding, temperature control, electrical safety systems, and technical supervision.

14. Product Safety and Industrial Use

Many products sold by the Seller are electrical heating components intended for industrial, professional, or technical use.

The Buyer is responsible for ensuring proper installation, electrical protection, temperature control, grounding, machine compatibility, and compliance with local safety regulations.

The Seller recommends the use of appropriate protection systems, including but not limited to:

  • thermostat

  • thermocouple or PT100 sensor

  • temperature controller

  • SSR or contactor

  • fuse protection

  • over-temperature protection

  • proper grounding

  • mechanical protection

  • correct cable protection

  • correct insulation

  • adequate ventilation or heat transfer

Products must not be operated outside their technical limits.

The Seller is not responsible for damage caused by incorrect installation, incorrect electrical connection, lack of protection, lack of temperature control, unsuitable working conditions, or unauthorized modifications.

15. Privacy Policy

CALDOR HEAT & ENGINEERING S.R.L., processes personal data only for legitimate business, contractual, accounting, tax, delivery, warranty, communication, and legal purposes.

Personal data may be used for:

  • customer communication

  • order processing

  • invoicing

  • delivery and courier services

  • account management

  • warranty management

  • technical service

  • payment verification

  • legal, accounting, and tax obligations

  • service notifications related to orders or products

CALDOR HEAT ENGINEERING S.R.L. undertakes not to disclose personal data to unnecessary, unrelated, or unauthorized third-party companies.

Personal data may be shared only where necessary with service providers involved in the performance of the order, such as courier companies, payment service providers, accounting service providers, ERP systems, IT service providers, legal consultants, tax authorities, or public authorities, where required by law or necessary for the execution of the contract.

Personal data shall be processed in accordance with applicable data protection regulations, including the General Data Protection Regulation (GDPR).

A separate Privacy Policy may be published on the official websites and shall apply together with these Terms and Conditions.

16. Complaints and Dispute Resolution

Any complaint related to an order, delivery, product, invoice, warranty, or technical issue must be submitted in writing to:

The complaint must include:

  • Buyer name

  • company name, where applicable

  • invoice number

  • order number

  • product code or description

  • photographs, where relevant

  • technical description of the issue

  • measurements or test results, where relevant

  • delivery date

  • contact details

The Seller will review the complaint and may request additional information, photographs, videos, product return, technical inspection, or installation details.

For products requiring technical verification, the Buyer must return the product to the Seller or to the location indicated by the Seller.

A complaint does not automatically suspend payment obligations unless expressly agreed in writing by the Seller or required by mandatory law.

Consumers may also use the complaint and alternative dispute resolution mechanisms made available by the competent Romanian consumer protection authorities, where applicable.

17. Debt Recovery and Late Payment

The Buyer must pay all invoices according to the payment terms stated on the invoice, proforma invoice, order confirmation, or written agreement.

Late payments may result in suspension of delivery, suspension of production, refusal of new orders, cancellation of pending orders, debt recovery procedures, late payment penalties, legal costs, collection costs, and reporting to authorized debt recovery or credit insurance partners, where applicable.

For B2B transactions, late payment may be treated in accordance with Romanian law and European Union rules regarding late payment in commercial transactions, including Directive 2011/7/EU and applicable Romanian implementing legislation.

Incorrect, incomplete, delayed, misdirected, or unconfirmed payments shall remain the responsibility of the Buyer.

Payment to an incorrect account, in an incorrect currency, without correct invoice reference, or based on outdated or unconfirmed banking details does not discharge the payment obligation.

18. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Romanian law and, where applicable, by mandatory European Union law.

For B2B transactions, any dispute arising from or in connection with these Terms, orders, invoices, deliveries, products, or contractual relations shall be submitted to the competent courts of Romania, unless otherwise agreed in writing.

For Consumer transactions, this clause does not affect any mandatory consumer rights or mandatory jurisdiction rules provided by Romanian or European Union law.

The Seller reserves the right to use legal, fiscal, debt recovery, insurance, or enforcement procedures available under Romanian law and applicable European Union regulations, including cross-border recovery mechanisms where applicable.

20. Policy Update and Applicability

This Terms and Conditions document was updated on 01/01/2026.

All orders placed from 15/01/2026 onwards are subject to these Terms and Conditions.

By placing an order with CALDOR HEAT & ENGINEERING S.R.L., the Buyer acknowledges and accepts these conditions.

The Buyer is required to review and accept these Terms before placing an order. Acceptance of these Terms does not affect any mandatory rights granted to Consumers under Romanian or European Union law.

Claims such as “I did not see,” “I did not read,” or “I was not aware of these conditions” do not constitute valid grounds for dispute and do not create liability for CALDOR HEAT & ENGINEERING S.R.L., provided that these Terms were made available to the Buyer before order confirmation and mandatory consumer information requirements were respected.

The latest version of this policy is always available on the official company websites.

CALDOR HEAT & ENGINEERING S.R.L., reserves the right to update, amend, or replace these Terms and Conditions at any time. The applicable version is the version valid at the time the order is placed, unless mandatory law provides otherwise.
